L’outil d’ACV simplifié destiné à l’affichage environnemental du secteur textile et habillement, ci-après « l’Outil Spin’It®,», est propriété de la société CYCLECO, SAS au capital de 20.000 €, dont le siège social est situé 1011, avenue Léon Blum – 01500 AMBERIEU, immatriculée sous le numéro 519 001 812, représentée par Jérôme PAYET, en sa qualité de Président.

Simplified LCA tool intended to be used in the framework of ecological labeling in textile and clothing sector, hereafter “Spin’It ®tool”, belongs to the company CYCLECO, SAS with a capital of 20.000 €, headquartered at 1011 avenue Léon Blum – 01500 AMBERIEU, registered under number 519 001 812, represented by Jérôme PAYET as President.

CYCLECO a porté le plus grand soin à l’élaboration de l’Outil Spin’It®. Cependant, l’Utilisateur déclare avoir pleinement conscience qu’il s’agit d’un outil d’aide simplifié qui ne saurait se substituer à une analyse approfondie et circonstanciée menée par un expert.

CYCLECO put high quality to developing of the Spin’It ® tool. However, the User declares to have full awareness that it is a simplified tool to aid which can not replace a further and detailed analysis maid by an expert.

Les INFORMATIONS (telles que définies infra) issues de l’Outil ne sauraient être considérées comme spécifiques à la situation de l’Utilisateur. Il ne peut être exclu que certaines INFORMATIONS soient obsolètes, incomplètes ou inexactes. CYCLECO ne peut garantir les INFORMATIONS issues de l’Outil Spin’It®. L’Utilisateur reste seul responsable de procéder à l’examen de l’actualité, de la complétude et de l’exactitude des INFORMATIONS issues de l’Outil Spin’It®.

INFORMATION (as defined further) from the Spin’It® tool shall not be considered as specific to the User’s situation. It can not be excluded that some INFORMATION are obsolete, incomplete or inaccurate. CYCLECO does not warranty INFORMATION taken out from the Spin’It® tool. The User remains solely liable for checking the timeliness, the completeness and the accuracy of any INFORMATION taken out from the Spin’It® tool.

Il ressort des termes du paragraphe précédent que la responsabilité de CYCLECO ne pourra en aucun cas être recherchée quant à tout préjudice direct ou indirect, éventuel ou actuel, lié ou non aux INFORMATIONS issues de l’utilisation de l’Outil Spin’It®.

Last paragraph terms mean that under no circumstances CYCLECO can be held responsible for any direct or indirect, potential or actual prejudice, related or not to INFORMATION taken out from the Spin’it® tool.

En dehors des conditions spécifiques stipulées dans le contrat d’utilisation signé par les deux parties, les conditions d’utilisation suivantes font foi :

At the exception of some specific conditions included in the using agreement signed by the parties, following conditions are binding :

L’Utilisateur de l’Outil Spin’It® s’engage à garder secrètes les INFORMATIONS qui lui sont transmises par CYCLECO dans le cadre de l’utilisation de l’Outil Spin’It® permettant l’Analyse du Cycle de Vie (ACV) des produits textile et s’interdit d’exploiter tout ou partie de ces INFORMATIONS sans l’accord exprès et préalable de CYCLECO. Il est notamment précisé que l’Utilisateur qui bénéficie d’un accès gratuit à l’Outil Spin’It® dans le cadre d’une période d’essai n’est pas autorisé à utiliser ledit Outil pour une autre fin que celle de tester ses fonctionnalités. Il est notamment précisé que le fait de réaliser une ou des analyses de cycle de vie :

• au bénéfice de tiers, et/ou

• pour son propre compte,

n’est pas autorisé, dans le cadre d’une période d’essai, que ces analyses soient complètes ou non et qu’elles donnent lieu à rémunération ou non.

The Spin’It® tool User undertakes to keep secret any INFORMATION which CYCLECO could provide in the framework of the using o fthe Spin’It® tool which allows the Life Cycle Assessment (LCA) of textile products and refrains to exploit all or part of these INFORMATION without the express and prior consent of CYCLECO. In particular, it is specified that the User who has an free-of-charge access to the Spin’It® tool in the framework of a test period is not allowed to use the above mentioned tool for any other goal that testing its functionalities. In particular, it is specified that the fact of making one or several life cycle assessments for any third party or for his own benefit is not allowed, in the framework of a testing period, these assessments would be complete or not and would be under remuneration or not.

Il est expressément stipulé qu’aucun résultat ou valeur par défaut ne pourra être communiqué à un tiers à quelque fin que ce soit. De même, toute copie d’écran ou élaboration de tout élément s’inspirant de l’Outil Spin’It® sera considérée comme constitutive d’une contrefaçon.

It is expressly specified that no result or default value could be communicated to any third party for whatever purpose. Any screen capturing or any element development which would be inspired from the Spin’It® tool shall be considered as a counterfeiting.

Par INFORMATIONS transmises dans le cadre de l’utilisation de l’Outil Spin’It®, il convient d’entendre toutes données, savoir-faire, textes, illustrations, ainsi que toutes informations à caractère technique, scientifique, industriel, économique, artistique, ou commercial ainsi que toutes composantes de l’Analyse du Cycle de vie telles que développées par CYCLECO (Ici dénommées les « INFORMATIONS »).

« Information » transmitted in the framework of the using of the Spin’It® tool shall be understood as any data, know-how, text, illustration, as well as any technical, scientific, industrial, economic, artistic or commercial, and any part of the Life Cycle Assessment as they are developed by CYCLECO (hereafter called “Information”).

Ne sont pas comprises dans les INFORMATIONS soumises à confidentialité :

1. les données environnementales nationales ou internationales publiques ou privées - libres de droit;

2. le rapport généré automatiquement propre à l’Utilisateur.

3. les informations dont la société CYCLECO pourra prouver : qu’elles étaient du domaine public au moment de leur communication ; qu’elle les a légalement reçues d’un tiers autorisé à les divulguer ; qu’elles étaient déjà en sa possession au moment de leur communication.

Are not considered as INFORMATION which shall be under confidentiality:

1. National or international environmental data, public or private, free of rights

2. Automatically generated report which is specific to the User

3. Information about which CYCLECO would prove that : they were in the public domain at the time of their communication to CYCLECO; CYCLECO had received them legally from any third party allowed to disclose them; CYCLECO already had them in possession at the time of their communication.

Les données transmises par le (les) propriétaire(s) de bases de données, dont l’identification et la transmission sont encadrées par les accords directement établis entre CYCLECO et le propriétaire de données indépendamment du Site, sont soumises à confidentialité à l’égard des tiers et librement utilisables par le (les) propriétaire(s) de données.

Data transmitted by database owner, whose identification and transmission are subject to an agreement directly established between the data owner and CYCLECO independently of the website, are subject to confidentiality to any third party and can be freely used by the data owner.

Les INFORMATIONS transmises par l’Utilisateur restent sa propriété exclusive.

INFORMATION that the User would provide remains his exclusive propriety.

L’Utilisateur s’engage à garder secrètes à l’égard de tous, toutes les INFORMATIONS qui lui sont transmises par la société CYCLECO et à ne les divulguer à aucun tiers.

The User undertakes to keep secret to anyone any INFORMATION which CYCLECO would provide and not to disclose them to any third party.

En conséquence, l’Utilisateur:

1. s’engage à ne révéler les INFORMATIONS qu’à des collaborateurs responsables tenus au secret professionnel et directement concernés par l’Analyse du Cycle de vie,

2. s’interdit de communiquer les INFORMATIONS en tout ou partie, sous quelque forme que ce soit, à des tiers, sans l’accord écrit et préalable de la société CYCLECO,

3. s’engage à prendre toutes les mesures nécessaires au respect de la confidentialité des INFORMATIONS,

Il s’engage ainsi à soumettre les INFORMATIONS au même processus de conservation et de protection que ses propres documents et informations confidentiels, de manière à éviter toute publication et/ou divulgation et/ou exploitation non autorisées des INFORMATIONS.

4. se porte-fort du respect du présent accord par les membres de son personnel, de ses sociétés mère, sœurs et filiales.

Cet engagement de confidentialité s’applique à l’Utilisateur tel qu’il s’est identifié lors de la demande de mise à disposition de l’Outil et également à tout préposé.

5. s’interdit de copier ou laisser copier en totalité ou en partie les INFORMATIONS, sauf accord préalable écrit de la société CYCLECO,

In consequence, the User:

1. undertakes to reveal Information only to employee in charge and bound by professional confidentiality and directly involved in the Life Cycle Assessment,

2. refrains to pass any of the Information, in whole or in part, under any form, to any third party, without the written and prior consent of CYCLECO,

3. undertakes to take all necessary measures to the Information confidentiality respect,

The User commits itself to subject any Information to the same process of preservation and protection as its own confidential documents and information in order to prevent any publication and / or disclosure and / or unauthorized use of Information

4. is surety for compliance with this agreement by the members of its staff, its parent companies, subsidiaries and sisters,

The present secrecy agreement applies to the User as identified on the website and to any of his agent.

5. agrees nor to copy neither to let copy, in whole or in part, the components of the Project without the written and prior consent of CYCLECO.

L’Utilisateur reconnaît que la réception des INFORMATIONS de CYCLECO n’implique aucun droit de licence ou de cession d’un quelconque droit de propriété intellectuelle.

The User admits that reception from CYCLECO of any Information doesn’t involve any right to license or transfer of any copyright.

L’Utilisateur reconnaît que toutes les INFORMATIONS communiquées demeurent la propriété exclusive de la Société CYCLECO.

The User admits that all passed Information remains CYCLECO exclusive property.

L’Utilisateur s’engage à ne pas utiliser les INFORMATIONS sans l’accord exprès et préalable de CYCLECO, lequel devra prendre la forme d’un accord écrit.

The User undertakes not to use the Information without TOOLS FOR ENVIRONMENT prior and express consent, which shall be under the form of a written development agreement

L’Utilisateur s’interdit ainsi notamment et irrévocablement tout développement de projets reproduisant ou s’inspirant de l’outil d’application de l’Analyse du Cycle de vie développé par CYCLECO accessible notamment sur l’Internet, tout acte de contrefaçon par reproduction et/ou représentation et/ou adaptation de tout ou partie de l’outil d’application de l’Analyse du Cycle de vie développé par CYCLECO accessible notamment sur l’Internet, et/ou tout acte de concurrence déloyale commis, directement ou indirectement, par elle et/ou par toute personne morale (en particulier sociétés mère, sœurs, filiales, etc.) qui est directement ou indirectement, en fait ou en droit en position de contrôler ou en position d’être contrôlée par l’Utilisateur, seule ou de concert, sans l’accord préalable et exprès de CYCLECO.

The User irrevocably prohibits himself to develop any project copying or being inspired of the Spin’It® tool developed by CYCLECO, available in particular on the Internet, any act of counterfeiting by copying and/or representing and/or adapting all or part of the application tool developed by CYCLECO and which is in particular available on the internet and / or any act of unfair competition committed, directly or indirectly by it and / or any entity (companies in particular mothers, sisters, subsidiaries, etc..) directly or indirectly, in fact or in law in position of control or be controlled by the User, either alone or in concert, without the express prior consent of CYCLECO.

Par exception à ce qui précède, ne sont pas soumises à confidentialité les INFORMATIONS transmises par l’Utilisateur lors de l’utilisation de l’Outil et saisies sur ce dernier pour les besoins du service.

As an exception to the above, Information which are transmitted by the User during the tool using and entered into the tool are not subject to confidentiality.

CYCLECO s’engage à :

1. conserver les INFORMATIONS transmises par l’Utilisateur dans un emplacement sécurisé sur demande expresse de l’Utilisateur

2. ne pas effectuer ni laisser effectuer des copies des INFORMATIONS transmises par l’Utilisateur autres que celles nécessaires à son activité ;

3. ne transmettre les INFORMATIONS propriété de l’Utilisateur qu’aux membres de son personnel qui, astreints au secret professionnel, en auraient besoin ;

4. ne pas utiliser les INFORMATIONS transmises par l’Utilisateur pour d’autres usages que l’élaboration d’une base de données semi-spécifiques dans le domaine du textile.

CYCLECO undertakes to:

1. keep INFORMATION transmitted by the User in a secure location after explicit call from the User

2. not to copy nor to let copying of the INFORMATION transmitted by the User at the exception of those necessary to his activity

3. to transfer User’s INFORMATION only to its employees who, bound by professional confidentiality, would need this INFORMATION.

4. Not to use User’s INFORMATION for any other use that the construction of a semi-specific database in the textile sector.

Conformément à la loi n°78-17 du 6 janvier 1978 « Informatique et Libertés » modifiée en 2004, la collecte et le traitement de vos données à caractère personnel ont fait l'objet d'une déclaration auprès de la Commission Nationale de l'Informatique et des Libertés (CNIL) sous le numéro de récépissé 1541393. Conformément aux articles 39 et suivants de cette même loi, l’Utilisateur peut obtenir communication et, le cas échéant, rectification ou suppression des informations le concernant, en s’adressant à la société CYCLECO par courrier électronique à info@cycleco.eu.

In accordance with the Act of Parliament n°78-17 of the January 6th 1978 « Informatique et liberté”, modified in 2004, collect and treatment of your personal data had been subject to a statement to the Commission Nationale de l’Informatique et des Libertés (CNIL) under number 1541393. In accordance with the article 39 and seq. of the same Act, the User can obtain right to access, correct and remove any personal data, by contacting CYCLECO by e-mail at info@cycleco.eu .
